Cancellation Policy, Right of Withdrawal

You have the right to revoke this contract within fourteen days (14) without giving reasons.  The withdrawal period shall be fourteen days from the date on which you or a third party other than the carrier who took or has taken possession of the goods designated by you and who is the carrier.

inform you by means of a clear statement (e.g. a letter, fax or email sent by post) of your decision to revoke this Agreement. You can use the attached model withdrawal form, which is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation

If you revoke this Agreement, we shall reimburse you immediately and no later than fourteen days (14) from the date on which we receive notice of your revocation of this Agreement for all payments we have received from you, including delivery charges (other than additional charges arising from your choice of a method of delivery other than the cheapest domestic standard delivery offered by us). For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

We may refuse to refund until we have received the Goods back or until you have provided evidence that you have returned the Goods, whichever is earlier.

You must return or hand over the goods to our customer service immediately and in any case within fourteen days (14) at the latest from the day on which you notify us of the revocation of this contract. The time limit is only met if you dispatch the goods before the expiry of the fourteen-day period (14). You shall bear the direct costs of returning the goods.

They shall be liable for any depreciation of the goods only if such depreciation is due to handling of the goods which is not necessary to examine their nature, properties and functionality.

Exclusion or premature expiration of the right of revocation: The right of revocation does not apply in the cases specified in §312g paragraph 2 BGB. In addition, this right of withdrawal does not apply to contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or destination by you is decisive or which are clearly tailored to your personal needs, or to contracts for the delivery of goods which can spoil quickly or whose expiration date would quickly be exceeded.

Data protection: The provisions of our data protection declaration apply.

Liability

Aspriter.com is liable in case of claims for damages, which are based on intent or gross negligence including intent or gross negligence of its representatives or agents, according to the statutory provisions. It shall also be liable in accordance with the statutory provisions if an essential contractual obligation (cardinal obligation) is culpably breached. In this case the liability is limited to the amount of the foreseeable, typically occurring damage. The claim for damages expires within twelve months (12) after delivery.

The mandatory liability according to the product liability law as well as the liability due to culpable injury of life, body or health remain unaffected.

Unless otherwise agreed above, liability is excluded. This also applies to the personal liability of the employees, representatives and vicarious agents of Aspriter.com.

Final provisions

For merchants, the exclusive place of jurisdiction and place of performance is Siegburg.  The law of the Federal Republic of Germany shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods.  Should one of these provisions be ineffective, the statutory regulation shall apply. The rest of the contract remains effective.
